{"id":32166,"date":"2026-09-30T19:04:13","date_gmt":"2026-09-30T23:04:13","guid":{"rendered":"https:\/\/ncnguyana.com\/2023\/?p=32166"},"modified":"2026-09-30T19:04:13","modified_gmt":"2026-09-30T23:04:13","slug":"courts-to-see-more-cases-targeting-criminal-assets","status":"publish","type":"post","link":"https:\/\/ncnguyana.com\/2023\/courts-to-see-more-cases-targeting-criminal-assets\/","title":{"rendered":"Courts to see more cases targeting criminal assets"},"content":{"rendered":"<div id=\"fb-root\"><\/div>\n\n<p class=\"wp-block-paragraph\">-by Kimberly Giddings<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Guyana\u2019s courts could soon see more applications seeking to freeze bank accounts, detain properties and confiscate assets suspected to be linked to criminal activities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Attorney General and Minister of Legal Affairs Anil Nandlall,made the comments following last week\u2019s 27th Regional Conference of the Americas for INTERPOL, held in Guyana, where the need to follow criminal money was highlighted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He&nbsp;says the country\u2019s approach to fighting organised crime is changing, with greater emphasis now being placed on tracing the money and going after the assets of criminal enterprises.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Attorney general says&nbsp;this means magistrates and judges must be prepared for a growing number of applications under the emerging asset-recovery framework.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cRepeated applications will now be made to the various courts across the judicial spectrum for orders such as freezing orders to freeze bank accounts, detention orders to detain properties, as well as forfeiture orders to confiscate properties that are implicated in or are considered proceeds of crime and criminality,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nandlall says prosecutors and other justice sector officials will also have to adapt as the legislation is developed to support the new approach to fighting crime.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He says those responsible for interpreting and applying the laws must become part of the wider machinery, which requires coordination among several investigative and enforcement agencies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These include the Guyana Police Force,&nbsp;GRA,&nbsp;CANU&nbsp;the Financial Intelligence Unit, the Special Organised Crime Unit and the Guyana Geology and Mines Commission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201c<strong>So all the important players have to be in sync if we are to succeed against a very evolving and sophisticated criminal world, because the criminals are investing heavily in technology, in equipment, and in, they are exploiting every new innovation available, and unless, on the other side of the law, these multiple agencies respond with commensurate sophistication\u00a0and efficiency,\u00a0then the criminals will continue to win the battle<\/strong>,\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nandlall says the conference came at an important time, with countries across the Americas moving toward a more unified approach to tackling crime.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He says the discussions and messaging from the conference could strengthen efforts to combat crime in Guyana, across the region and internationally.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>-by Kimberly Giddings Guyana\u2019s courts could soon see more applications seeking to freeze bank accounts, detain properties and confiscate assets suspected to be linked to criminal activities.
