{"id":31714,"date":"2026-09-01T21:04:35","date_gmt":"2026-09-02T01:04:35","guid":{"rendered":"https:\/\/ncnguyana.com\/2023\/?p=31714"},"modified":"2026-09-01T21:07:51","modified_gmt":"2026-09-02T01:07:51","slug":"mohamed-extradition-hearing-set-to-resume-thursday","status":"publish","type":"post","link":"https:\/\/ncnguyana.com\/2023\/mohamed-extradition-hearing-set-to-resume-thursday\/","title":{"rendered":"Mohameds&#8217; extradition hearing set to resume Thursday"},"content":{"rendered":"<div id=\"fb-root\"><\/div>\n\n<p class=\"wp-block-paragraph\">The extradition proceedings involving the Mohameds are set to resume before the Magistrates\u2019 Court on Thursday, with the Attorney General saying there is now \u201cno ambiguity\u201d over the way forward following the latest rulings by the Court of Appeal and the Caribbean Court of Justice (CCJ).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Attorney General said the CCJ\u2019s decision has effectively cleared the way for the Magistrates\u2019 Court to continue the committal proceedings, while maintaining the restriction that the magistrate cannot make a final decision until the Mohameds\u2019 appeal is determined by the Court of Appeal.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u201cThat now paves the way unequivocally for the magistrate to resume the hearing,\u201d<\/strong> the Attorney General said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The development follows an August 26 ruling by the Court of Appeal, which rejected the Mohammeds\u2019 attempt to have the Magistrates\u2019 Court proceedings stayed while their appeal remains pending.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, the Court of Appeal ordered that the extradition proceedings continue, but that the final disposition of the matter by the magistrate be stayed until the appeal is heard and determined. The appeal has been scheduled for October 13.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Mohammeds subsequently approached the CCJ seeking, among other things, an interim stay of the extradition proceedings while they pursued special leave to appeal the Court of Appeal\u2019s decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The CCJ ultimately dismissed those applications, leaving the Court of Appeal\u2019s order intact.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Attorney General said the distinction is important, as Thursday\u2019s resumption of the proceedings does not mean the magistrate will be able to conclude the matter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>\u201cThe magistrate is ordered to proceed but cannot make a final decision until the Court of Appeal hears the appeal,\u201d<\/strong> he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The underlying appeal concerns a constitutional challenge brought by the Mohammeds against provisions of the Fugitive Offenders Act.
